These Terms & Conditions govern your use of the CleverAlpha AI Advisor, a free anonymous financial check-up. They supplement — and do not replace — CleverAlpha Asset Management’s Privacy Notice.
1. What the Tool is — and what it is not
The Tool is a free, anonymous educational financial check-up provided by CleverAlpha Asset Management LLC (“CleverAlpha,” “we,” “us”). It generates a general financial scorecard and an AI-generated written analysis based on the answers you provide.
The Tool is not:
- Personalized investment advice
- A recommendation to buy, sell, or hold any security
- A financial plan, tax plan, or estate plan
- A solicitation to open an advisory account
- A substitute for professional advice from a qualified adviser, accountant, or attorney
Nothing in the scorecard or the emailed analysis creates an advisory relationship between you and CleverAlpha. An advisory relationship is formed only through a signed advisory agreement.
2. Eligibility
You must be at least 18 years old and a U.S. resident to use the Tool. By using the Tool you represent that you meet these requirements.
3. Educational use only
The scorecard bands, pillar milestones, and written analysis are educational content generated from generalized inputs. They do not consider your full financial picture, tax situation, risk tolerance, or specific goals. Do not rely on the Tool as the sole basis for any financial decision. You are solely responsible for decisions you make based on information from the Tool.
Past performance, illustrative ranges, and general observations in the analysis are not indicative of future results. Investing involves risk, including possible loss of principal.
4. AI-generated content
The written analysis is produced by third-party AI providers. AI-generated text may contain errors, omissions, or outdated information. CleverAlpha reviews the underlying prompts and scoring logic but does not review each individual analysis before delivery.
You should independently verify any specific figure, tax rule, contribution limit, or regulatory statement before acting on it. Where the analysis and these Terms conflict, these Terms control.
5. No warranty
The Tool is provided “as is” and “as available” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. CleverAlpha does not warrant that the Tool will be uninterrupted, error-free, or secure against all threats.
6. Limitation of liability
To the fullest extent permitted by law, CleverAlpha, its affiliates, and its service providers will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Tool, even if advised of the possibility of such damages. CleverAlpha’s total aggregate liability arising out of or related to the Tool will not exceed one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law, including any fiduciary duties CleverAlpha owes to advisory clients under a signed advisory agreement.
7. Your conduct
You agree not to:
- Submit false, misleading, or automated inputs
- Attempt to reverse-engineer, scrape, or overload the Tool
- Use the Tool to develop a competing product
- Use the Tool for anything other than a personal, non-commercial financial check-up
We may rate-limit or block access to the Tool at our discretion.
8. Intellectual property
The Tool, including its scoring methodology, copy, design, and code, is owned by CleverAlpha or its licensors and is protected by U.S. and international intellectual property laws. Your emailed analysis is licensed to you for personal reference only.
9. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or related to the Tool will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
Nothing in this section limits your rights under federal securities laws, which cannot be waived.
